Terms of Service
1. Acceptance of Terms
By accessing or using PaxPally, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our platform. These terms apply to all visitors, users, creators, agencies, and others who access or use the service.
2. Eligibility
You must be at least 18 years old to create an account and use PaxPally. By registering, you represent and warrant that you have the legal capacity to enter into a binding contract and that all information you provide is accurate, complete, and current.
3. Account Registration
When you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. PaxPally will not be liable for any loss or damage arising from your failure to comply with this obligation.
4. Platform Rules and Content
You are solely responsible for any content you post, upload, publish, or otherwise make available on PaxPally (“User Content”). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the platform.
You agree not to post content that:
- Is illegal, fraudulent, defamatory, obscene, pornographic, or invasive of privacy.
- Infringes on any intellectual property rights or proprietary rights of any party.
- Contains viruses, malware, or any other harmful code.
- Harasses, abuses, or threatens others, or promotes discrimination or violence.
- Impersonates any person or entity, or misrepresents your affiliation with any person or entity.
5. Subscriptions, Payments, and Refunds
Subscriptions: Creators may offer subscription plans. By subscribing, you authorize us to charge your selected payment method on a recurring basis until you cancel. Payments are processed via mobile money or cryptocurrency (USDC on Base).
Tips and PPV: You may purchase tips or pay-per-view (PPV) content. These are one-time charges and are non-refundable except where required by law.
Cancellations: You may cancel your subscription at any time from your account settings. Cancellation stops auto-renewal and you will retain access until the end of the current billing period. We do not provide prorated refunds for partial months.
6. Intellectual Property
The PaxPally platform, including its software, design, text, graphics, logos, and trademarks, is the property of PaxPally or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform without our prior written consent.
7. Termination
We reserve the right to suspend or terminate your account and access to the platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the platform will immediately cease.
8. Limitation of Liability
To the maximum extent permitted by law, PaxPally shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or in connection with your use of the platform. Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PaxPally operates, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
10. Changes to Terms
We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated terms on this page and updating the “Last updated” date. Your continued use of the platform after any changes constitutes acceptance of the revised terms.
